Terms of Service

These Terms govern your use of SellEngine, a commerce operations service provided by Kanha Ji Enterprises (“we”, “us”, or “SellEngine”) from Narnaul, Haryana, India. By creating an account or using the service, you agree to these Terms.

1. Eligibility and accounts

You must be at least 18 years old and legally able to operate the business represented in your account. You are responsible for accurate account information, secure credentials, activity under your account, and access granted to team members.

2. Service

SellEngine provides tools for order entry, inventory, customers, storefronts, payments, reporting, shipping workflows, and related commerce operations. Feature availability, usage limits, and support levels depend on your current plan. We may improve or replace features while preserving the core purpose of a paid service.

3. Merchant responsibilities

You are the merchant of record for sales made through your storefront. You are solely responsible for products, pricing, taxes, invoices, fulfilment, shipping, returns, refunds, customer support, legal notices, and compliance with applicable consumer, ecommerce, tax, messaging, and product laws.

4. Acceptable use

You may not use SellEngine for unlawful, deceptive, infringing, unsafe, or abusive activity; upload malicious code; attempt unauthorized access; interfere with the service; or use customer data beyond a lawful business purpose. We may restrict access where reasonably necessary to protect users, customers, or the service.

5. Plans, trials, and payments

New eligible accounts receive a seven-day Starter trial unless otherwise stated. Paid access begins after payment is verified. Prices, taxes, billing cycles, renewal terms, and plan limits are shown before purchase. Except where required by law or expressly agreed, fees for a started billing period are non-refundable.

6. Customer and business data

You retain ownership of business data you submit. You authorize us and our infrastructure providers to process that data only to operate, secure, support, and improve the service, comply with law, and follow your documented instructions. You must have a lawful basis to collect and upload customer data.

7. Availability and third parties

We aim to provide a reliable service but do not promise uninterrupted availability. Shipping, WhatsApp, payment, hosting, email, and other third-party services have their own terms and may change or become unavailable. We are not responsible for third-party acts outside our reasonable control.

8. Intellectual property

SellEngine software, branding, and documentation remain our property or that of our licensors. We grant you a limited, non-exclusive, non-transferable right to use the service during your authorized subscription.

9. Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for material breach, non-payment, security risk, or unlawful use. Where practical, we will provide notice and a reasonable opportunity to cure. Data export or deletion requests can be sent to the contact below.

10. Liability

To the extent permitted by law, SellEngine is provided without implied warranties and we are not liable for indirect, special, incidental, or consequential losses. Our total liability relating to a paid service will not exceed the fees you paid for the service during the three months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.

11. Governing law and disputes

These Terms are governed by Indian law. Courts with jurisdiction over Narnaul, Haryana will have exclusive jurisdiction, subject to any mandatory consumer forum rights.
